Welcome to FitToFile. These terms explain what you can expect from us, and what we ask of you, when you use our website and services. By using FitToFile, you agree to these terms, so please take a few minutes to read them.
1. What FitToFile is
FitToFile is a technology platform that helps you protect your brand name. We offer two things.
The first is a free trademark clearance search. You enter a proposed business or brand name, pick the industries you plan to operate in, and we search federal USPTO trademark records and give you a plain-English read on what we find.
The second is a guided trademark filing service. You answer a set of questions about the name you want to register, and we route your filing request to independent licensed trademark attorneys who handle the actual filing with the USPTO.
FitToFile provides the technology and connects you with attorneys. It is not a law firm and does not itself practice law. When you use the site, you agree to these terms.
2. The clearance search
The clearance search is an informational first look. It searches public USPTO records for marks that may be similar to the name you entered, runs an automated analysis, and returns a clearance score, a list of potential conflicts, and a plain-English summary.
It is a helpful starting point, but it is not a guarantee. A clean-looking search does not promise that a name is available, registrable, or free of conflict, and a worrying result does not always mean a name is out of reach. The search is not legal advice.
The complete picture comes from a licensed attorney. A full clearance opinion weighs the search results against the law and the specifics of your business, and that is work a trademark attorney does. The free search is designed to get you to that conversation well informed.
3. The filing service
When you use the guided filing flow, you give us the information a USPTO trademark application needs, such as the mark, the goods and services, the owner or applicant details, and your contact information. Submitting this flow creates a filing request.
A filing request is not itself a filing with the USPTO. FitToFile routes your request to independent licensed trademark attorneys, who review it and handle the actual application. The attorney handling your matter will confirm the details with you before anything is filed.
4. Attorneys and the attorney-client relationship
The legal work behind FitToFile is performed by independent licensed trademark attorneys, not by FitToFile itself. We are the platform that connects you with them.
Running a search or submitting a filing request does not by itself create an attorney-client relationship. That relationship begins when you formally engage an attorney and the attorney agrees to represent you. Until then, nothing on the site is legal advice and nothing you send through it is protected as a confidential attorney-client communication.
We mention this not to hold you at arm's length, but so you know exactly where you stand. Real attorneys stand behind the filing service, and the point of the search and the intake flow is to get you to that representation prepared and informed.
5. Your responsibilities
We ask two things of you. First, give us accurate and complete information. The search results and the filing request are only as good as what you enter, and a trademark application built on incorrect details can cause real problems down the line.
Second, use the site lawfully. Please do not use FitToFile to break the law, infringe someone else's rights, or interfere with how the site works for other people.
6. No guarantees and limitation of liability
The search relies on public USPTO records and on third-party data, and that information can be incomplete, delayed, or out of date. We work to keep the service accurate and useful, but we cannot promise it is error-free or that it will catch every possible conflict.
FitToFile is provided on an "as is" and "as available" basis, without warranties of any kind. To the fullest extent allowed by law, FitToFile is not liable for indirect, incidental, or consequential damages arising from your use of the site, and our total liability for any claim relating to the service is limited to the amount you paid us for it, which for the free search is zero. Nothing here limits any liability that cannot be limited under the law.
7. Intellectual property
FitToFile owns the website, the software behind it, and the FitToFile name and brand. Please do not copy or reuse them without our permission.
You keep ownership of what you submit, such as the names you search and the details you enter into a filing request. You give us permission to use that information to provide the service, including routing your filing request to an attorney, as described in our Privacy Policy.
8. Changes to the service and these terms
FitToFile is an evolving product, so we may add, change, or remove features over time. We may also update these terms. When we make a meaningful change, we will update the "Last updated" date above, and significant changes may be communicated more directly. Continuing to use the site after an update means you accept the revised terms.
