This policy explains, in plain English, what information FitToFile collects, why we collect it, and what we do with it. In short: we collect what we need to run your trademark search and prepare your filing request, we share it with the licensed attorneys and service providers who help deliver the service, and we do not sell your personal information.
1. What we collect
Information you give us. When you run a clearance search, we collect the names you search, the industries you select, and the email address you enter to view your results.
When you submit a filing request, we collect what a USPTO trademark application needs. That includes the owner or applicant's name, business and entity details, mailing address, phone number, and email, along with the mark itself and the goods and services it covers.
Information collected automatically. Like most websites, we collect basic usage and log data when you visit, such as your device and browser type, general location, and how you move through the site. This helps us keep FitToFile working well.
2. How we use your information
We use the information we collect to:
- Run your trademark search and show you the results.
- Prepare your filing request and route it to licensed trademark attorneys.
- Contact you about your search or your filing, including following up on a request.
- Maintain, troubleshoot, and improve the service.
3. Who we share it with
Licensed trademark attorneys. Sharing your filing request with independent licensed trademark attorneys is core to the filing service. They receive the details of your request so they can review it and handle the USPTO filing.
Service providers. We work with companies that help us run FitToFile. These include a trademark-data provider that supplies the search records, an AI provider that processes search inputs to produce the automated analysis, and hosting, database, and infrastructure providers that store data and keep the site running. They may only use your information to provide services to us.
When legally required. We may disclose information if the law requires it, or to protect the rights, safety, and property of FitToFile, our users, or others.
We do not sell your personal information.
4. Data retention
We keep your information in our database for as long as we need it to provide the service, follow up on your search or filing, and meet our legal and record-keeping obligations. When we no longer need it, we take steps to delete it or remove the details that identify you.
5. Your choices
You can ask us for a copy of the personal information we hold about you, or ask us to delete it. Just email us using the contact details below, and we will respond as the law requires. Note that some information may need to be kept where the law calls for it.
6. Security
We use reasonable technical and organizational measures to protect your information. That said, no website or method of storing data is completely secure, so we cannot guarantee absolute security.
7. A note on public trademark records
The trademark records behind the search come from public USPTO data. Once a trademark application is filed with the USPTO, much of its information, including the mark and the applicant's details, becomes part of the public record maintained by the USPTO. That is a feature of the federal trademark system and is outside FitToFile's control.
8. Changes to this policy
We may update this policy as FitToFile evolves or as the law changes. When we make a meaningful change, we will update the "Last updated" date above, and significant changes may be communicated more directly.
